Mandatory consultation of the Immigration Department

 

Belgian embassies and consulates must forward visa applications to the Immigration Department in the following situations:

  • The applicant does not (sufficiently) demonstrate compliance with the conditions for entry to the Schengen area;
  • The embassy or consulate believes there is a migration risk (insufficient guarantees of return) or a security risk;
  • The applicant did not leave the Schengen area before the expiry date of their visa during a previous trip;
  • The applicant was pushed back to the Schengen external borders during a previous trip and his visa was annulled or revoked;
  • The applicant was repatriated during a previous stay in the Schengen area;
  • A Schengen State has opposed the issuance of the visa applied for; [More information on  prior consultation with one or more Schengen States].
  • The Immigration Office or another Schengen state refused to issue the visa on a previous application;
  • The applicant presents a travel document not recognised by Belgium;
  • The applicant does not produce a travel document or a valid travel document;
  • The applicant presents a refugee or stateless person's travel document;
  • The applicant does not legally reside in the jurisdiction of the embassy or consulate in which he submits his application;
  • The applicant is a minor and is travelling alone or accompanied by one of his parents who cannot produce the permission to travel given by the other parent;
  • The applicant is involved in an adoption project or process ;
  • The applicant is travelling for medical reasons;
  • The applicant is travelling as part of a religious activity;
  • The applicant is travelling in the course of a trade in used vehicles;
  • The applicant cites humanitarian reasons.
