A distinction must be made between studying at a recognized higher education institution, i.e., an institution recognized by the competent authority, which is authorized to organize a higher education program and award the corresponding academic titles, degrees, diplomas, and certificates, and training at a recognized higher education institution.
The conditions for admission to a recognized higher education institution are laid down in articles 58 and following of the Act of December 15, 1980, on the entry, stay, establishment, and removal of foreigners. Non-EU foreigners who meet these conditions are authorized to stay in Belgium as students.
Applications for residence permits to study at a non-recognized (private) educational institution are examined in detail by the Immigration Office in accordance with the discretionary power conferred by Article 9 of the aforementioned law. The documents and information provided are evaluated strictly, in particular the detailed description of the applicant's academic background and academic and professional plans.
